Uber and Lyft accident insurance in California: which coverage may apply?

An Uber or Lyft collision can look like an ordinary car accident at the scene, but the insurance analysis may be different. California ties transportation-network-company coverage to what the driver was doing in the app when the crash occurred. The driver's status can determine which policy layer needs to be evaluated and which trip records should be preserved.

Start by identifying the driver's app status

A useful rideshare investigation asks whether the driver was offline, logged into the app and waiting for a request, traveling to pick up a passenger after accepting a ride, or actively transporting a passenger. Those are not interchangeable situations for insurance purposes.

Passengers can usually confirm part of that timeline through the trip receipt and app history. When another road user is injured by a rideshare driver, other records may be needed to establish the driver's status.

California uses different coverage periods

California Public Utilities Commission requirements divide rideshare activity into coverage periods. During the period when a driver is logged in and waiting for a ride request, the required primary liability limits are lower than the commercial coverage that applies after a ride has been accepted.

Once the driver has accepted a ride and is traveling to pick up the passenger, and while the passenger is being transported, California requires $1 million in primary commercial liability insurance. The passenger-transport period also includes $1 million in uninsured and underinsured motorist coverage under the CPUC requirements.

Preserve the trip information early

Keep the ride receipt, screenshots, pickup and destination details, driver name, vehicle information, in-app communications, photographs, police-report information, and any messages from Uber, Lyft, or an insurer. Do not assume the app will always display the same information months later.

If you were not the rideshare passenger, record anything showing the rideshare vehicle and driver and preserve ordinary scene evidence such as photographs, witnesses, video, and vehicle information.

More than one policy may need to be reviewed

The driver's personal auto policy, the transportation-network-company policy, another driver's policy, a vehicle owner's policy, an employer or commercial policy, and uninsured or underinsured motorist coverage can all become relevant depending on the facts.

The existence of a rideshare company does not automatically mean every injury is covered by the same $1 million policy. The app status and the role of each vehicle still need to be established.

Passenger claims can still involve fault questions

A rideshare passenger may have no responsibility for how the vehicles were driven, but the drivers and insurers can still dispute which driver caused the collision. That can make scene evidence, witness information, video, reports, and vehicle damage important even when the injured passenger did nothing wrong.

When several vehicles are involved, the claim may need to evaluate more than one responsible party and more than one insurance policy.

The injury still has to be documented like any other claim

Rideshare coverage does not replace the need to prove damages. Medical treatment, future care, lost wages, earning impact, daily limitations, and other losses still need reliable support.

Keep the rideshare evidence and the medical/financial evidence together. One explains which coverage may apply; the other explains what the collision actually cost the injured person.
